The Department of Energy’s and the Public Utilities Commission’s rules govern utilities, energy providers, and other entities subject to the Department's or the Commission’s authority.

RUL 2024-003 - Department of Energy Chapter En 400 Rules for Telephone Utilities

The Department is adopting rules pursuant to its authority over telephone utilities under RSA 12-P enacted effective July 1, 2021, RSA 365:1, RSA 374:3 & :4, RSA 374:22-p and RSA 374:59, as amended effective July 1, 2021, and RSA 274:22-g as amended effective August 20, 2022.  The Chapter En 400 rules are based upon the existing Puc 400 rules of the Public Utilities Commission in order to effectuate the allocation of responsibilities between the Department and the Commission enacted by HB 2 (2021).

RUL 2024-002 - Department of Energy Chapter En 800 Rules for Underground Utility Damage Prevention Program

The Department is adopting rules pursuant to its authority over the Underground Utility Damage Prevention Program under RSA 12-P:5, IV and RSA 374:50.  The Chapter En 800 rules are based upon the existing Puc 800 rules of the Public Utilities Commission in order to effectuate the allocation of responsibilities between the Department and the Commission enacted by HB 2 (2021).

RUL 2024-001 - Department of Energy Chapter En 1200 Rules for Uniform Admin of Utility Customer Relations

The Department is adopting rules pursuant to its authority over utilities under RSA 12-P enacted effective July 1, 2021, RSA 365:1 & :2, as amended effective July 1, 2021, and RSA 363-B as amended effective August 20, 2022.  The Chapter En 1200 rules are based upon the existing Puc 1200 rules of the Public Utilities Commission in order to effectuate the allocation of responsibilities between the Department and the Commission enacted by HB 2 (2021).

RUL 2023-005 - Department of Energy Chapter En 1500 Rules for Licenses for Crossings of Public Waters or State Land

The Department is adopting rules pursuant to its authority under RSA 12-P:5, IV and RSA 371:22 relating to applications for licenses regarding crossings over public waters or State land.

RUL 2023-004 - Department of Energy Chapter En 700 Rules for Sewer Service

The Department is adopting rules pursuant to its authority over sewer utilities under RSA 12-P, RSA 362, RSA 370 and RSA 374, as amended effective July 1, 2021.  The En 700 rules are based upon the existing Chapter Puc 700 rules of the Public Utilities Commission in order to effectuate the allocation of responsibilities between the Department and the Commission enacted by HB2 (2021).

RUL 2023-003 - Department of Energy Chapter En 600 Rules for Water Service

The Department is adopting rules pursuant to its authority over water utilities under RSA 12-P, RSA 362, RSA 370 and RSA 374, as amended effective July 1, 2021.  The En 600 rules are based upon the existing Chapter Puc 600 rules of the Public Utilities Commission in order to effectuate the allocation of responsibilities between the Department and the Commission enacted by HB2 (2021).

RUL 2023-002 - Department of Energy Chapter En 500 Rules for Gas Service

The Department is adopting rules pursuant to its authority over gas utilities under RSA 12-P, RSA 362, RSA 369, RSA 370 and RSA 374, as amended effective July 1, 2021.  The En 500 rules are based upon the existing Chapter Puc 500 rules of the Public Utilities Commission in order to effectuate the allocation of responsibilities between the Department and the Commission enacted by HB2 (2021).

RUL 2023-001 - Department of Energy Chapter En 1400 Rules for Pipeline Public Utilities

The Department is adopting rules pursuant to its authority over pipeline public utilities under RSA 12-P and RSA 374, as amended effective July 1, 2021. En 1400 includes substantially the same rules as Parts Puc 1401, 1402, and 1403 of the existing Chapter Puc 1400 rules of the Public Utility Commission (PUC) in order to effectuate the allocation of responsibilities between the Department and the Commission enacted by HB2 (2021).

RUL 2022-001 - Department of Energy Chapter En 1300 Utility Pole Attachment Rules

The Department is adopting rules pursuant to its authority related to utility pole attachments under RSA 12-P and RSA 374, as amended effective July 1, 2021. En 1300 includes substantially the same rules as Parts Puc 1301, 1302, and 1303 of the existing Chapter Puc 1300 rules of the Public Utilities Commission (PUC), except for the addition of provisions for One-Touch Make-Ready procedures and timelines as required under Senate Bill 88 (2021).  Part Puc 1304, which covers dispute resolution and related pole attachment fee rate-setting, will remain with the PUC in an amended version of Puc 1300.
